ASSEMBLY AMENDMENT 1, TO 2003 ASSEMBLY BILL 510

AB510-AA1,1,1 At the locations indicated, amend the bill as follows:

AB510-AA1,1,3 1. Page 23, line 16: delete the material beginning with that line and ending with page 24, line 7, and substitute:

AB510-AA1,1,4 " Section 43a. 43.01 (3) of the statutes is amended to read:

AB510-AA1,1,7 43.01 (3) "Municipality" means a city, district under s. 229.86 (3), village, town, tribal government or tribal association, or a school district that maintained and operated a public library facility prior to December 17, 1971.

AB510-AA1, s. 46m Section 46m. 43.54 (1r) of the statutes is created to read:

AB510-AA1,1,11 43.54 (1r) (a) Boards appointed for a library operated by a district under s. 229.86 (3) shall consist of 7 to 11 members, as determined by the agreement under s. 229.861 (3) who shall be appointed by the commission under s. 229.86 (2).

AB510-AA1,1,12 (b) Subsections (1) (b) to (e) and (2) apply to boards under this subsection.

AB510-AA1, s. 46r Section 46r. 43.64 (2) (c) of the statutes is created to read:

AB510-AA1,2,4 43.64 (2) (c) Except as provided in sub. (2m), municipality that is part of a district under s. 229.86 (3) is exempt from the tax levy if the district provides support for its public library in an amount at least equal to the amount calculated under par. (b).".

AB510-AA1,2,5 2. Page 47, line 13: delete "60" and substitute "90".

AB510-AA1,2,6 3. Page 54, line 6: after "if" insert ", except as provided in par. (am),".

AB510-AA1,2,7 4. Page 54, line 10: after that line insert:

AB510-AA1,2,14 "(am) A municipality that has been in a district for at least 25 years may withdraw from the district without the approval of the governing body of any other municipality if the municipality adopts a resolution declaring its intention to withdraw from the district. If such a resolution is adopted by a municipality, it may not take effect earlier than 3 years after the resolution is adopted. The other provisions of this subsection, as they apply to other municipalities that withdraw from a district, apply to a municipality that withdraws under this paragraph.".

AB510-AA1,2,15 5. Page 56, line 8: delete "all" and substitute "at least 50%".

AB510-AA1,2,16 6. Page 67, line 3: after that line insert:

AB510-AA1,2,18 "(7) No municipality may impose a school and park land dedication fee under s. 236.45 if a district imposes an impact fee under s. 66.0617 for a similar purpose.".
